What is Gratuity? (End of Service Benefits)
Gratuity, officially known as End of Service Benefit (EOSB), is a mandatory lump-sum financial benefit paid to employees upon termination of employment in the UAE. Why Dates Instead of "Years of Service"?

Understanding Gratuity Rates Under UAE Labour Law
- Less than 1 Year of Service: No gratuity is payable, regardless of contract type or reason for leaving.
- 1 to 5 Years: 21 days of basic salary for each year of service.
- Beyond 5 Years: 30 days of basic salary for each year of service beyond the fifth.
- Maximum Gratuity Cap: Limited to 2 years' worth of salary (730 days), regardless of total service length.

Limited Contracts (Current Standard)
Limited Contracts have been the only standard employment contract type in the UAE since February 2023. Key points for gratuity:
- Full gratuity payment after 1 year of service, even if you resign.
- No deductions or penalties for early resignation, provided notice is served.
- 21 days/year for the first 5 years, 30 days/year after.
- When a contract is renewed, service periods are cumulative for gratuity purposes (Article 38).
Unlimited Contracts (Legacy)
Unlimited Contracts were phased out for new hires in February 2023 but still apply to some employees hired before that date. On a legacy Unlimited Contract, resignation reduces your entitlement:

This reduction only applies to resignation on a legacy Unlimited Contract. If you are terminated rather than resigning, you receive the full standard entitlement regardless of contract type.
Can Gratuity Be Denied? (Article 139)
Gratuity is a legal entitlement, but it can be forfeited entirely under Article 139 of UAE Labour Law in specific circumstances:
- Dismissal for gross misconduct under Article 120 โ for example proven fraud, using a false identity, or a serious breach of contract.
- Resigning without serving the required notice period, in some cases.
- Leaving before completing one year of continuous service, regardless of the reason.
Outside of these specific situations, an employer cannot lawfully withhold your gratuity. If you believe your gratuity has been unfairly denied or reduced, you can raise a complaint with MOHRE.
